Please read these Terms of Use carefully since by using the Futera Network, you are confirming that you have read and understood, and agree to be bound by these Terms of Use and that you have read and understood and agree to be bound by the terms of our Privacy Policy. If you do not agree to these Terms of Use and Privacy Policy, you may not use the Futera Network. By using any of our websites you agree to be legally bound by these terms, which shall take effect immediately on your first use. Eligibility: You affirm that you are fully able and competent to enter into these Terms of Use and to abide by and comply with them. If you are under 13 years of age, you affirm that you have obtained the consent of your parent or legal guardian to use this website. Futera FZ LLC may sell products for individuals under the age of 18 years, but purchases must be completed by adults who are able and authorised to make purchases with a credit card and/or through a Paypal account. Credit card payments are processed via the Paypal system. Futera reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion for any reason whatsoever including, without limitation, if you provide registration information which is false, inaccurate, not current, or incomplete.

The trade marks, logos, trade names, game names, characters, brands and product names appearing on the Futera Network are trademarks/service marks or registered trademarks/service marks of Futera FZ LLC or of the appropriate third parties. Nothing contained in these terms shall be construed as conferring by implication, or otherwise any licence or right to use any trademark, patent, design right or copyright of Futera FZ LLC or of any other third party. The copying or use of any trademark or service mark or images without express written consent of the respective holder is strictly prohibited. The Futera Network is provided for your personal, non-commercial use only. Any other use of our content is strictly prohibited.

Unless otherwise stated, neither Futera nor any of its sports cards/virtual cards/collectibles/services and/or other activity are endorsed or sponsored by any of the players, teams, associations, bodies, sponsors, events, kit or clothing manufacturers who may appear in our collections, nor are any cards/collections/services/other item or activity representative of, or associated with, or endorsed by any Player/Team/Club/League/Association/Event including any World Cup and no association should be inferred between Futera products/artwork and any World Cup, Competition or other Championship, Olympics or other Event or title. Futera football/soccer cards and/or collectibles are not official products of the Royal Spanish Football Federation (RFEF). Futera football/soccer cards and/or collectibles are not official products of The FA (The Football Association) or of any other sports body unless otherwise stated.

Every care is taken to ensure products do not intentionally infringe any trademarks or intellectual property rights and the Company will be glad to rectify any issue relating to the above that is brought to their attention. All Futera copyright publications contain approved images provided from international sources under formal Licences and/or Agreements. All material is published in good faith as having been supplied for publication.

Statistics and card information are understood to be accurate at time of print. Futera FZLLC undertakes comprehensive research in order to provide interesting and informative data relating to the subject matter but cannot be held responsible for omissions or inaccuracies. Futera will be pleased to address any anomaly or concern as appropriate upon being advised of such.

YOUR RESPONSIBILITIES: By using the Futera Network, you agree to: (a) provide true, accurate, current, and complete information as prompted by any registration/application form and maintain/update such information.

WE ASK THAT YOU DO NOT USE THE SAME USER NAME AND/OR PASSWORD for World Football Online and/or other Futera services as you use for other online activities such as your personal email accounts (such as ‘Hotmail’). See Privacy Policy notes below.

You agree not to use the Futera Network to violate any local, state, national, or international law or regulation; transmit or threaten to transmit any material that is abusive, distasteful, harassing, tortious, defamatory, cause anxiety to other users, vulgar, pornographic, obscene, libelous, invasive of another’s privacy or racially, ethnically, or otherwise objectionable; transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam or any other form of solicitation; knowingly transmit any material that contains adware, malware, spyware, viruses, or any other computer code, files, programs, or take any action that may interrupt or affect the functionality or cause any irregularity of the Futera Network and/or service for its users. Such actions can be traced and depending on its nature, the appropriate Authorities would be involved. Where deemed appropriate by Futera, the user’s account may be closed, the IP address registered and blocked with loss of card functionality.

Futera does not, as part of a regular, established practice, monitor, control, or have knowledge of all content transmitted through the Futera Network. You agree that you are solely responsible for all content you transmit and receive using the Futera Network.

We do not warrant that functions contained in our services and content will be uninterrupted or error free, that defects will be corrected, or that Futera FZ LLC or the server that makes it available are free of viruses or bugs. Futera makes no representation or warranty as to the completeness or accuracy of the information contained on the Futera Network(s), not does it represent or warrant that the products or services offered or advertised through the Futera Network(s) will be available at all times.

If it is necessary for us to interrupt the Services then we may do so without telling you first. You acknowledge that the Services may also be interrupted for reasons beyond our control. You agree that we are not liable to you for any loss whether foreseeable or not arising as a result of any interruption to the Services. Our Programmers strive to ensure that our website(s) run in line with their intended operation, however technical problems may occasionally occur. We try to solve technical problems in a timely manner, and no claim will be accepted as a consequence of the methods used to rectify such technical problems and/or the consequences arising from such remedial action. Please note that for some technical issues external specialist companies may be involved and the hours of operation of such companies may result in some delay in rectifying a technical issue, and we hereby request the understanding and patience of users during such times. Under no circumstances will we be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of online card selection and/or position; © loss of position in competition/tournament/division/other; (d) loss of prizewinning position or potential to win a prize (e) loss of opportunity; (f) loss of revenue or anticipated profits or of anticipated savings or reward; (g) loss of business; (h) loss of goodwill or injury to reputation; (i) losses suffered by third parties; or (j) any indirect, consequential, special or exemplary damages arising from the use of our website(s)/network regardless of the form of action. You are advised that Content may include technical inaccuracies or typographical errors.

Futera FC: We make every effort to provide the VIRTUAL MANAGER LIVE interactive service to our customers, but interruption to or loss of this service and other associated services may occur due to reasons outside our control such as broadcasting issues or loss of internet connection or transmission power and for which Futera can not be held responsible.

Futera FC games may be cancelled with little or no notice due to poor weather conditions and/or pitch condition and League/Team anomalies and we apologise for any inconvenience caused by such circumstances which may prevent transmission of a game.

You agree to indemnify us against any claims, demands, actions, costs, proceedings, expenses, loss or damage, including reasonable lawyers’ fees by any third party due to or arising out of your use of the Services, the breach or violation of this Agreement by you, or the infringement by you, or by any other User using your computer, of any intellectual property or other right of any person or entity.

Futera shall not be liable for any action taken by you as a result of your relying on any information provided through the Futera network, website(s) or third party websites or for any loss or damage suffered by you as a result of you taking such action.

PROHIBITED ACTIONS, COMMUNICATIONS and SECURITY
The following are strictly forbidden and risk immediate Account and IP Ban:-

a) Attempting to gain unauthorised access to restricted areas of the Game server.
b) Attempting to gain unauthorised access to another player’s account, personal details, account details.
c) Using this Game as a means of conducting unlawful activities including crimes such as hacking, phishing, using keyloggers, scamming.
d) Attempting to Interfere with the accounts of others or with the system itself.
e) Sharing your game account with another individual; this is the case for the lifetime of the account, it does not matter if the account is not currently in use by its owner.
f) Using the facilities for commercial gain.
g) Gaining unauthorised access to or violating the privacy of other people’s data.
h) Attempting to corrupt or destroy either the Game or other players’ data or accounts.
i)Exploiting any bugs in the game or website to gain an advantage or put others at a disadvantage
j) Creating and/or transmitting material likely to cause anxiety, annoyance or offence to Futera and/or other users.
k) Creating or threatening to create and/or to transmit material that is defamatory, untrue, personal speculation of a negative nature, gossip or rumour.
l) Any threatening, abusive or other communication causing anxiety to Futera or any of its staff on any matter whatsoever, and/or which contains threat to disrupt or have an adverse effect on Futera services or their reputation, may result in the author’s account being suspended and being prohibited to utilise the facilities of the Futera network ongoing.
m) Creating and/or transmitting negative comments which could have an adverse affect on other players’ confidence or enjoyment of World Football Online and/or other Futera services.
n) Unnecessarily monopolising the Forum or other areas of the Futera network with personal views or comments, or other content of a non-helpful nature
o) Threats to publish or make defamatory remarks about Futera, the brand of its nework. Note: Defamation is a statement that gives a negative impression of a person, company, group, product, government, or country.

NOTE 1) Please remember that the Futera network, including the Forum, is for the use and enjoyment of everyone and is not a platform for personal grievances and/or negative comments about other players. In the event of posts being applied to our Network which are deemed of an unacceptable nature due to foul language or content or negative remarks against other users of the Network, these will be removed and the individual’s account/access may be suspended or banned without notice. NOTE 2) Our programmers together with new security alert systems are able to detect attempts at unauthorised access and can also trace communications back to their source. Please observe our terms & conditions for fair play and respect to others.

ADMINISTRATION, DEVELOPMENT TEAM RESPONSES, ANNOUNCEMENT OF PRIZES, AWARD OF TOKENS, FUTERAVCARDS AND/OR OTHER
Announcements of Prizewinners, the sending of FuteraVcards and/or other Futera products, awards, prizes/offers/other can involve various departments and several processing procedures and it can take some time for results to be published and/or items to be despatched. On occasion, awards/prizes are held pending checks into tournaments prior to releasing prizewinner information and/or despatching prizes. We thank you for your patience.

Futera reads and attends to every email received. The nature of a sender’s email may require attention by more than one Futera staff member and/or involve more than one department and affect the response time in some instances you may not receive an acknowledgement although the matter of your communication will already be under consideration or being attended to. Whilst we endeavour to acknowledge emails in a timely manner, we ask that you allow 7 days before contacting us further. Enquiries/communications are dealt with chronologically and in sequence as they are received by Futera, although in the event of an issue of a serious nature these may be referred for priority action. This will be at the discretion of Futera and the response time will be as appropriate to the situation. In the case of account investigations this may take up to or in excess of 30 days. Please refer to our terms & conditions relating to communications with Futera staff and the mutual courtesy in how communications should be conducted. In the event that we are unable to respond as quickly as we would like, either in acknowledging your communication or dealing with your issue, we appreciate your patience and be assured that all matters are dealt with in as timely a manner as is possible for the Futera staff involved.

CHAT FACILITY
Futera accepts no liability for communications or messages or content posted and/or transmitted to or received by users through forums/blogs/chat facilities/other. If you receive or observe messages that you feel are inappropriate or offensive please contact Admin@futera.com with proof of the incident (please take a screenshot of the comment) and we will take appropriate action against the user concerned.

Inappropriate communications, such as swearing or offensive remarks, or any other matter which causes a concern to Futera or its customers, are taken seriously and any such concerns may result in the user(s) having their account(s) suspended and in extreme circumstances deleted and blocked from all Futera websites with consequent loss of cards from their account. Such action may be taken at the sole discretion of the Futera FZ LLC website moderators and no appeals can be considered nor communications entered into.

FORUM/BLOG/FACEBOOK/TWITTER/FUTERA TV/FUTERA FC/FWF MAGAZINE and other services provided through or associated with the Futera Network: Neither Futera nor its network endorse in any way the views and opinions of posts, presenters, commentators, contributors or individuals nor does it vouch for the accuracy or authenticity of same.

Forum members and those publishing content on any part of the Futera network are solely responsible for the accuracy and authenticity of their posts, including any alterations made to posts.

Any individual found to be deliberately posting misleading or deceptive information, or carrying out illegal or unauthorised activities will have their account(s) terminated without notice and any offending posts removed immediately. Their details may also be passed to the appropriate Authorities.

Because of the nature of the internet, although in most cases IP addresses and offender details can be identified, this may not always be possible. The person may also be in a particular overseas jurisdiction where it may not be possible to take any legal action against them.

Futera accepts no liability for the content of any communications or messages received by you from other users including any content posted by other users in forums/blogs/chat facilities/other.

SECURITY
Anyone identified as attempting to gain unauthorised access to the system will have their Team banned immediately.

The security policing system can trigger an AUTOMATED identification and account removal action, and no communication will be entered into.

Using ANY method, however minor, to try to gain an unfair advantage over other players is NOT acceptable by Futera – hacking, phishing, using keyloggers, ghosting, scamming or any other action which abuses our normal play service are criminal.

IMPORTANT: Hacking is illegal, so you will not just lose your World Football Online Account and cards, but as the new security system will automatically report your IP address to the Authorities you may also be contacted by them directly.

Hacking is a computer crime punishable by FINES or PRISON.

Where we provide a service without specific charge, then it is deemed free of charge, and not to be associated with any other service for which a charge is made. Accordingly there is neither contractual nor other obligation upon us in respect of any such service.

We are not responsible for any or all advertisements on our website(s) including but not limited to goods or services or other material advertised by Advertisers. Each such offer is provided at the sole discretion and subject to the terms and conditions, as applicable, of the respective Advertiser. We give no warranty and accept no liability in relation to any such offer.

Creative, fictional and/or design theme elements including star ratings, titles and descriptions contained in Futera sticker, card and online products /collectibles/ services should not be regarded as being representative of actual abilities, skills or other attributes of any individual, team, club, country, sport, event or other; nor do such creative elements reflect the views or opinions of FFZLLC in relation to any individual, team, club, country, sport, event or skills or attributes thereof. For example a card showing a design element with 2 stars may be played to the same or greater effect as a card showing a design element with 5 stars – the stars do not relate to any individual or individual’s skill; nor do such creative elements reflect the views or opinions of Futera in relation to any individual, team, club, country, sport, event or skills or attributes thereof.

The information contained on the website(s) may become out of date at any time and Futera makes no commitment and expressly disclaims any duty to update any of the content of the Futera Network. Futera FZ LLC reserves the right to add, modify, or delete any information on the Futera Network at any time without notice.

Futera reserves the right to change the price and availability of any of its content at any time without notice; provided, however, any price change will not affect your purchase price for orders that Futera FZ LLC has already received from you which Futera has directly confirmed in writing as being available and the order accepted and already paid for in full and instruction given for processing and despatch. In the event of technical issues which cause an incorrect price to be displayed temporarily without our knowledge (and/or for periods of under 30 minutes), we refer you to our policy relating to the Order Completion Process whereby the submission of your Order and payment details via Paypal does not constitute acceptance of your order by Futera FZLLC which would be subject to availability of the item(s) ordered and our acceptance of the order, and only upon despatch of your order will the order process be deemed complete. Our current minimum order value is 9 Euros including p&p. In the event of cancellation following despatch of order, you would return the order to us by tracked service (at your cost) and upon our receipt of the returned item a refund would be given.

Terms relating to Delivery of Products and Postal Services – please read
It is your responsibility to ensure that you enter full and accurate details for your name and physical postal address when submitting an order either direct to Futera via email, or through the Online Shop Paypal facility (please check your Paypal account is registered to your full physical address when submitting). Should you not submit your full and/or correct details Futera can take no responsibility for the loss or delay of your order and no refund can be provided. No changes to your postal/delivery address can be made following your order submission.

Futera FZ LLC shall endeavour to despatch properly ordered products within a reasonable amount of time (normally between 2-14 days from receipt of payment, subject to availability and processing requirements). The time taken for delivery is outside the control of Futera and will vary according to international and the customer’s local postal services. Please allow 28 days from acknowledgement of your order before becoming concerned as international shipping and clearance can take a little longer. Unless otherwise stated or advised, the total amount charged for your order will include post & packing (p&p) at standard postal first or second class postal rates and not for any special recorded or tracking service and claims of non-receipt will not be accepted following despatch of your order. If you require a special ‘Signed for’ or ‘Track and Trace’ or other type of postal service for your order, please ask for a quote within 24 hours of receiving our Order Acknowledgement email. Delayed postage: Following 30 days from your receipt of our Order Acknowledgement email, if you advise us that the item has still not been received, we will immediately commence a formal investigation through the Postal and/or Courier Services handling your order. Receipts are held for every customer order with details of the customer name, originating Post Office and date of despatch. A delayed/missing package can generally be identified either as on its way to the delivery address or on its return to the originator. The process may take several weeks until the Investigation is concluded by the Postal Service(s) concerned. Claims of non-delivery are not accepted due to the Post Office delivery operation being outside our control but we will be happy to provide the receipt of postage for your order for your assistance. For items sent by a recorded/registered/signed for service, Futera will provide you with the tracking number or receipt details for you to instruct your local or national Postal Service to conduct an investigation. Claims of non-delivery can not be accepted once orders are despatched from Futera.

It is your responsibility to provide us with your own true, accurate and complete name and delivery address when placing an order. In the event that you have provided information for a Courier or Registered delivery or other service which is not accurate or complete, or where your order is delivered but for any reason rejected or non-deliverable due to the name/address/telephone or other details provided by you, you will be responsible for covering the cost of any re-delivery necessary including added charges. If Futera have provided a subsidized courier, shipping or registered delivery service for your order, if the delivery is unable to be fulfilled by the service due to incorrect or incomplete information provided by you, you will be responsible for the full re-delivery cost (without subsidy) plus any additional charges and this payment will be required to be made to Futera or appointed service before a re-delivery is attempted (unless such service is provided free by the delivering service). In the event that such payment is not made upon request, your order may be held by, or returned to Futera by the delivering service until such time as full payment for the re-delivery plus any associated charges incurred as a result of the inability for your order to be delivered and/or accepted is made.

COURIER DELIVERIES generally take between 4-7 days from despatch depending on the receiving country’s customs clearance/local delivery methods and timings, etc. over which Futera has no control and Futera cannot be responsible for the loss or damage of any package whilst in the possession of a Courier/Shipper. You would, however, be provided with despatch details and any supportive paperwork relating to the despatch in order to support your investigation with the handling company concerned.

Futera’s liability for any product purchased through its website(s) is strictly limited to the purchase price value of that product. If the product is defective, Futera, at its discretion and upon its satisfaction following investigation into the cause of defect, may supply a replacement or otherwise remedy the item concerned.

Terms & Conditions relating to Card Insert Ratios and our Terms of Sale: Insert ratios stated are averages across an entire production run. As such, they give an AVERAGE of the quantities of different types of cards inserted into the whole manufacturing and packing processes and as such are not guaranteed to exist in any particular pack/box/case. Futera Collections involve many complicated procedures and processes and more of one type of insert card and less or none of others, and less or none of some and more of others may feed through the various processes into a pack/box/case. Insert ratios therefore give a ‘likelihood’ based on the number of inserts averaged across manufacture, and do not represent a specific number of a particular type of card that will be found in any particular pack/box/case.

Before purchasing please be sure you understand the above and that we hereby cannot accept claims for any box or case which does not contain a particular card mix, e.g. if a case mix has less than expected or none of a particular type of card this is not deemed as a shortfall, and no claim can be made. Replacement or additional cards cannot be provided in relation to any mix found in any particular box/case purchase. However, across the production run the ratios stated give a guidance of the likelihood of finding the range of cards subject to the above.

DITRIBUTORS/DEALERS: Terms relating to your Purchase from us If you are a Distributor/Dealer please make sure that your customers understand about the packing ratios.

Manager and Stadium FuteraVcards are ‘virtual cards’ and are not available in Packs.

Online Shop Offers, Facebook and other Offers through the Futera network are not associated with, and will not necessarily be the same as, card/FuteraVcard allocations and/or Offers available from other sources.

Futera Tokens hold no monetary value and can not be transferred or traded for cash.

SECONDARY MARKET TRADES OF CARDS, FUTERAVCARDS and CODES:-
 NOTICE TO SELLERS: Please be sure that you and your buyer fully complete any purchase/trading transaction together to your mutual satisfaction at the time of trade. Once you have arranged the de-registration of a uniquely coded Card/FuteraVcard, a period of 7 days must pass after the de-registration date before your Buyer can use that card/FuteraVcard. As the last person to have used and/or claimed ownership of the Card and/or Code, you as the Seller are responsible for keeping that code confidential, and ensuring that your Buyer has been able to register the card/code to complete your trade to the Buyer’s satisfaction. You may not trade a card/code that you are not the rightful owner of from commencement through to completion of your transaction with a buyer. If you inadvertently disclose a card or FuteraVcard unique code (either online or to a third party or otherwise) you must be aware that this could result in others abusing the use of that code and/or claiming it as their own. As such a situation would have arisen as a result of your own actions, Futera is not able to provide replacement codes in that event or become involved with claims from any of the parties involved. Please be very careful to keep unique codes of all your cards and FuteraVcards confidential at all times and particularly before, during and after a trade as the consequences of any unfair practices along the trading chain may affect you.

NOTICE TO BUYERS: Please be sure that you and the seller fully complete any trading transaction together to your mutual satisfaction at the time of your trade. Once the Seller has arranged the de-registration of the card/FuteraVcard, a period of 7 days must pass before you can register and use that card/FuteraVcard. As the last person to have used and/or claimed ownership of the card/code, the Seller is responsible for keeping that code confidential, and ensuring that you as the Buyer have been able to register the card/code to complete your trade. As the Buyer, it is your responsibility to check that you are satisfied with the transaction at the time it is made, and to keep unique codes of all your cards/FuteraVcards confidential at all times before, during and after a trade as the consequences of any unfair practices along the trading chain may affect you. Claims can not be sent to Futera for codes which do not work, or which have not been passed to you by your Seller, or are already registered. Claims can not be sent to Futera for cards which have been provided to you by the Seller damaged or where the Seller has accepted your payment but has not fulfilled their transaction. You must refer ALL enquiries about your transaction to the Seller involved. In the event of your Seller not settling your grievance to your satisfaction, you should refer the situation to Paypal or the service through which you conducted the Trade. Futera is unable to respond to emails concerning secondary market trades.

SELLER & BUYER: In the event of any problem arising with a card, FuteraVcard or code during or after trades at any stage, Sellers and Buyers must communicate together to solve the issue between themselves. IMPORTANT NOTE: Please do no contact Futera as we are unable to become involved with private transactions which have taken place through the secondary market at any time.

Our website(s) may contain links to other internet web sites. We have neither power nor control over any such website. You acknowledge and agree that we shall not be liable in any way for the content of any such linked web site, nor for any loss or damage arising from your use of any such website.

Communications with Futera: In the event that you have a grievance or in the general course of communications with Futera, we require that details of the situation are set out in a clear and fair manner and users of the Futera network communicate with our staff in a pleasant and courteous manner In the event that the tone of a communication is deemed to be of an abusive or disrespectful nature Futera will, at its discretion suspend communications with the party concerned until they advise that they are willing to continue dialogue in a polite and constructive manner. If our staff receive communication of a deliberately abusive nature, Futera has the right to suspend the account of the individual without notice and block their access to the Futera network.

Competition Terms & Conditions and Rules
Unless otherwise stated, the Promoters of a Trial, Tournament, Competition or other activity featured on the Futera Network are Futera FZ LLC (Registration No. 31701) Registered in Dubai, Dubai Media Citiy, Dubai, United Arab Emirates. Unless otherwise acknowledged, these rules apply to all competitions, tournaments, trials, Prize Weeks or other such situation/offer operated by the Company varied only as circumstances may require. Rules pertaining to certain promotions may only appear on specific literature – eg leaflets, mailouts, newspaper adverts, etc.

Participation instructions form part of these rules. All entrants must agree to abide by these rules. Entering multiple Teams into any competition or prize-winning event is prohibited. Entrants found to have won, or be attempting to win or play by dishonest or unfair means may be disqualified, their cards removed from the Game until further notice and any prize forfeited, and be subject to other penalty action by the Development Team at their discretion including being requested to return a prize which has been deemed to have been won by unfair means.

The submission of an entry shall be deemed to indicate acceptance of these Terms and all rules set out herein and as per Terms & Conditions published on the website. Participation in Trials/Tournaments/Competitions/other activities via the Futera Network, unless stated otherwise, are international and open to residents of all countries subject to relevant Registration terms & conditions applying at the time of participation. Participation in a National-specific competition if stated is solely restricted to residents of that country, with prize delivery only to a prizewinner’s own addresses in the country stated. Competitions, Tournaments and/or other events which offer a ‘prize’ or reward are not open to employees or members of their immediate families, participating clients or anyone connected with the promotion of the competition or event and in any event the decision of the company shall be final and legally binding.

Our competitions are intended to be fun and entertaining. Entering or participating in a competition does not create an enforceable contract and does not entitle the participant to enforce any claim against the Company. Unless otherwise stated, no purchase or payment is required. Entries must be received by before the stated closing date and /or time and subject to the absolute discretion of the Company, late entries will not be considered. Where the result may be a Draw, there may be a tie-breaker question, or a penalty shoot-out, or other appropriate method used to identify a clear winner as appropriate to the Competition type. However, the selection of a winning entrant will be at the Company’s sole discretion. No communication regarding results will be entered into. Whilst every care will be taken, the Company cannot be held responsible for the non-delivery, delay or loss of any entry. Proof of posting, texting or emailing is not accepted as proof of delivery. The decision of the Company as to acceptance of any entry shall be final. All entries become the property of the Company and unless otherwise agreed, cannot be returned. Entrants agree to their name, home-town and country being published on the website(s) and elsewhere. They agree to their participation details being published, broadcast and otherwise used without entitlement to any payment. Subject to the Company deciding otherwise only the stated prize(s) may be won. Prize values may be set by the supplier of the prize and not by The Company. Prize values are approximate at time of competition and may be subject to change. No cash alternative is available for non-cash prizes. In the event of the stated prize becoming unavailable the Company will, where appropriate, arrange the supply of an appropriate alternative at the Company’s sole discretion. In the event that there is more than one entry qualifying as a prospective winner of a prize which is by its nature divisible the prize may be shared, at the discretion of the Company. In the event of there being more than one prospective winner of a prize that is not by its nature divisible, the decision of the Company as to the ultimate winner, and the prize/award to be given, shall be final.

A prize will not be awarded to a person who, for any reason, would not be allowed by law to purchase or use the prize or where the supply to that person would otherwise be unlawful. Age limits may apply to certain prizes. Entrants outside such limits will be disqualified. For certain prizes, winners under 18 years of age must be accompanied on a journey or holiday or to an event by a parent or guardian or other responsible adult. The company notifies winners of competitions/tournaments/trials/other events by email and/or online announcement normally within 30 days of closing date and, where appropriate, will contact winners by email to make arrangements for the delivery of a prize. Such notification not acknowledged or responded to by a winner within 28 days of the first notification will result in their prize remaining the property of the Company to do with as it sees fit. Following receipt of a winner’s delivery address details, the Company would normally despatch the prize within 28 days. This would be subject to the availability of the prize which may be delayed in transit to the Company. In such circumstances a period of up to 60 days should be allowed before an alternative is considered.

Subject to the discretion of the Company, the names of (major) prize winners will be made available within 30 days following the closing date by publication on the appropriate website(s). The decision of the Company is final. No correspondence will be entered into concerning the Company’s decisions. The Company reserves the right to reject claims or applications and to alter, amend or foreclose the promotion without prior notice. While the Company will use its best endeavours to ensure that prizes are received by the actual winner they shall not be responsible for any failure to do so. The Promoters are not responsible for any incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilised in any activity, trial, tournament or competition, or by any technical error that may occur in the course of the administration of such. The Promoters assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. If for any reason the activity, trial, tournament or competition becomes incapable of running as planned, including but not limited to technical failures, or reasons beyond the control of the Promoters which affect the administration, security, fairness, or proper conduct of this promotion, the Promoters reserve the right in their sole discretion to cancel, terminate, modify, re-run or suspend the competition.

CARDS: Due to the individual hand-crafting and various finishing processes of Insert Cards slight imperfections in the print, foil or crafting processes may occur and are part of the character of the card.

Some autograph cards may feature marks incurred through the signing process such as pen or finger marks. Cards are signed where and how the player wants to sign including in different areas of the cards and sometimes with a full as well as an abbreviated style.

Occasionally a card may be damaged during transportation and/or handling and no claims can be made for such damage.

In the event of an obvious card production process fault you may notify Futera who may at their discretion seek to obtain a replacement card. However, as cards are generally packed at the time of production a replacement of a particular card type or player card may not be possible and if any alternative is offered it would be as a gesture of goodwill. Please note that there is no guarantee that if a card is offered to you that it would be of an equal or similar value and any gesture offered due to any card anomaly would be made as goodwill on the part of Futera and no negotiation is possible.

World Football Online League Position and Fair Play Regulations (to be read in conjunction and in accordance with the above Competition Terms & Conditions and Rules to which this also forms part):
Participation instructions form part of these rules. All entrants/players must agree to abide by these rules.

Multiple entries/registrations from one person, whether registered under the same or a different name, are prohibited. As for the ruling for Competitions, Tournaments Games and/or other events, participation in the World Football Online Game is limited to one entry/registration per person. Futera FZ LLC holds the right to suspend or delete multiple entries with consequent loss of card functionality. Entrants found to have won, or be attempting to win or play by dishonest or unfair means may be disqualified, their cards removed from the Game until further notice and any prize forfeited, and be subject to other penalty action by the Development Team at their discretion including being requested to return a prize which has been deemed to have been won by unfair means.

A Team’s position in a league table is dictated by the number of it points it has gained in any given week. The more points the Team has gained the higher up the table that Team will be. If points between 2 or more teams are tied, then the team with the higher ‘wins to games played’ ratio will be higher up the table. If this is still the same then the result is worked out on who has lost the least games. In the unlikely case of this still being the same then the placing is worked out by the which team is higher in the Futera All-Time Table (this is manually corrected by the FUTERA DEVELOPMENT TEAM). The decision of the Company is final. No correspondence will be entered into concerning the Company’s decisions.

In the event of any player/entrant/user of the Futera network/website(s)/World Football Online taking action which could cause an irregularity or failure of the service(s) provided, their IP address will be tracked, blocked and registered, their account banned, card functionality suspended and may have their details passed to the appropriate Authorities.

Privacy: When you register to become a member, Futera collects certain personal information about you. You agree that Futera may use such information in accordance with the provisions of Futera’s Privacy Policy (see below). Futera’s Privacy Policy is expressly incorporated into these Terms of Use.

User Names/Password/Security issues: You are responsible for maintaining the confidentiality of your user name and password, and you are solely responsible for all activities that occur under your password. You agree to immediately notify Futera of any unauthorized use of your password or any other breach of security related to the Futera Network. Futera reserves the right to require you to alter your password if Futera believes that your password is no longer secure. Futera WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO ADEQUATELY SAFEGUARD YOUR PASSWORD OR FOR ANY ACTIONS OCCURRING UNDER YOUR PASSWORD.

YOU ARE STRONGLY ADVISED NOT TO USE THE SAME USER NAME AND/OR PASSWORD for World Football Online and/or other Futera services as you use for other online activities such as your personal email accounts (such as ‘Hotmail’). One scam that the Authorities warn of is that a hacker could contact you through your personal email account to trick you into releasing your password, then use that password to access your other activities.

Termination: Futera reserves the right to terminate your membership and access to the Futera Network and at any time and without notice, for any reason whatsoever.

DISCLAIMER OF WARRANTIES: FUTERA HEREBY DISCLAIMS ALL WARRANTIES. FUTERA IS MAKING THE FUTERA NETWORK AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE FUTERA NETWORK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTERA EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE FUTERA NETWORK, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. When you visit the website(s) or send e-mails to us, you are communicating with us electronically. You consent to receiving communications from us electronically. We will communicate with you by e-mail or by posting notices on the website(s). You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Waiver: No waiver of any breach of any provision of these Terms of Use shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.

These disclaimers form an essential part of this agreement. Each sub paragraph in this agreement is independent and severable from each other paragraph and enforceable accordingly if any restriction is unenforceable for any reason but would be enforceable if part of the wording were deleted, it will apply with such minimal deletions as may be necessary to make it valid and enforceable.
